
Brazil’s new gambling regulator has issued new rules regarding advertising for the newly regulated online gambling market.
The SPA says that gambling advertising in Brazil should no longer use national symbols in advertising campaigns or marketing materials. This includes a ban on the use of the actual currency symbol or images of Brazilian banknotes and coins.
The regulator said the aim is to “prevent misleading statements that prizes will be paid in cash, which is prohibited by law.” It said failure to comply with the regulation could result in fines, suspension of marketing campaigns or revocation of authorization for future advertising campaigns. It also reminded operators that promotions involving prize giveaways must receive prior approval from the Ministry of Finance.
Meanwhile, the SPA provided details on how it calculates its administrative fees for the regulated online gambling market.
The regulator explained that its monthly supervision fee, which helps fund its operations, will be calculated based on gross gaming revenue after deductions, including player prizes. It must be paid by the 10th of the month following the distribution of prizes through the PagTesouro digital payment processing system, which is managed by the National Treasury. Payments can be made via PIX, credit card or GRU bank check.
There will be eight tiers, starting with a free BRL 54,419.56 (€9,000) for operators with BRL 30 million (€5 million) in revenue. The fee will increase to BRL 1,944,000 (€324,000) for revenues of BRL 660,960,000 or more (€110 million).
