Station Casinos recent request to the US Supreme Court to temporarily stop the lower court’s order while it continued its legal challenge was denied.
On 4th of September, Chief Justice John Roberts rejected Station’s emergency request for a stay. This means that Red Rock Red Rock has to comply with the NLRB order including recognizing the union and bargaining with it
Employees at Station Casinos’ Red Rock Casino Resort rejected unionizing in December 2019. The Culinary Union claimed that Station Casinos had distorted the election by improving employee benefits just prior to the vote.
The National Labor Relations Board agreed and concluded that the decision of Station Casinos had affected the outcome of the election. Therefore, the Red Rock Casino had to recognize the Culinary Union and negotiate with it, even though the employees had voted against unionization.
Station said in a statement:
The NLRB decision overturned the clear vote of Red Rock team members rejecting the Culinary Union. The decision prevents any company from granting benefits to its employees if it is aware of union interest in unionizing the company’s employees and nullifies the Red Rock team members’ vote to be union-free, all because Station Casinos treated its team members too well.
Anyway, the recent decision isn’t considered as the end of the case. The Station can still ask the Court to formally hear the underlying case.
