Brazil sets responsible gambling as 2025-26 priority

Brazil’s Secretariat of Prizes and Bets (SPA) has unveiled its regulatory agenda for 2025–26, placing strong emphasis on responsible gambling initiatives.

Following the official launch of Brazil’s regulated online gambling market on January 1, the SPA announced a public consultation aimed at assessing and enhancing the existing regulatory framework. That consultation closed on March 27 with around 200 submissions, and the SPA has now released its updated agenda through Normative Ordinance No. 817.

Article 2 of the ordinance outlines the key priorities, including promoting responsible gambling, preventing addiction, and fostering a fair, transparent regulatory environment.

Starting June 30, the SPA will release draft regulations at the end of each quarter, actively encouraging industry-wide input. The top priority for the biennium is the creation and implementation of a national self-exclusion platform, designed to reinforce responsible gambling and curb addiction. The SPA has labeled this initiative as the most critical on its agenda.

The regulator plans to publish documentation regarding this platform in Q2, alongside proposed enhancements to how betting companies allocate sponsorship and advertising resources to athletes and sports clubs. It also aims to establish clear criteria for a certification seal that would help consumers identify licensed operators.

To further support vulnerable gamblers, the SPA intends to strengthen its support guidelines, aiming to reduce the negative social impact of gambling. In Q3 2025, it will also update advertising regulations, which have been under scrutiny amid growing calls for tighter restrictions in the Senate.

Other agenda items include a review of the Exclusive Instant Lottery rules and a push to better regulate financial interactions between operators and providers, an effort to combat the black market and create a more cohesive betting ecosystem.

By Q4 2025, the SPA plans to launch a national betting system that aligns state-level laws with federal guidelines. In preparation, it has already engaged with state lawmakers at the Ministry of Finance to encourage regulatory harmonization.

Looking ahead to 2026, the SPA intends to enhance monitoring procedures to ensure that licensed operators are adequately supervised. Challenges in the initial licensing phase, particularly delays caused by limited certification bodies (only six are currently approved) – have prompted plans to revise the authorisation process based on lessons learned.

In Q2 2026, the SPA will reevaluate its certification process for both operators and suppliers to address previous setbacks. By Q4 2026, it will also reassess its penalties for fixed-odds betting operators that violate regulatory standards.

Recently, the SPA suspended four operators for failing to submit required documentation. While Pixbet has since resolved its issues and been fully licensed, the remaining three companies remain suspended pending certification.
